{"id":5280,"date":"2016-09-22T00:26:00","date_gmt":"2016-09-22T00:26:00","guid":{"rendered":"https:\/\/orpp.or.ke\/?p=5280"},"modified":"2023-10-30T08:51:29","modified_gmt":"2023-10-30T08:51:29","slug":"registrar-issues-procedure-for-expulsion-of-party-members","status":"publish","type":"post","link":"https:\/\/orpp.or.ke\/es\/registrar-issues-procedure-for-expulsion-of-party-members\/","title":{"rendered":"Registrar Issues Procedure for Expulsion of Party Members"},"content":{"rendered":"<p><span style=\"font-size: 8pt;\">by Ngala Joshua<\/span><br \/><span style=\"font-size: 8pt;\">Nairobi Kenya, Tuesday September 20, 2016<\/span><\/p>\n<p>The Registrar of Political Parties has today issued a procedure for expelling members of political parties who violate the law.&nbsp;<\/p>\n<p>This guideline comes at a wake of complaints from the public requesting that some members of a political party be deemed to have resigned by their actions.<\/p>\n<p>The Political Parties Act provides that a party member may only be expelled for contravening the party constitution, and after being accorded a fair hearing in accordance with internal dispute resolution mechanisms.<\/p>\n<p>\u201cA member of a political party may therefore be deemed to have resigned upon a resolution of the national executive committee of the political party\u201d, Said Lucy Ndungu. \u201cThe \u2018deemer\u2019 is a political party that must follow the established law for expulsion\u201d.<\/p>\n<p>Whenever the Registrar receives a complaint from any person requesting that a member of a political party be deemed to have resigned, the Registrar shall assess whether the complaint is justified or not.<\/p>\n<p>If justified the Registrar may make a declaration based on sufficient grounds for the person to be deemed to have resigned. The Registrar shall dismiss insufficient complaint and inform the complainant of the decision.<\/p>\n<p>Where the Registrar is of the opinion that there is a reasonably justifiable cause, the Registrar shall notify the person so complained of and the political party he is a member to.<\/p>\n<p>Such a party is therefore required it to, within seven days of the notification, constitute a national executive committee to consider whether or not the member can be deemed to have resigned, and to notify the Registrar accordingly.<\/p>\n<p>The Political Parties Act also provides for the procedures of resignation of party members.<\/p>\n<p><a href=\"\/es\/images\/UPLOADSpdf\/legalpositiononremovaofamember.pdf\/\" target=\"_blank\" rel=\"noopener noreferrer\" title=\"PROCEDURES FOR REMOVAL OF MEMBERS OF A POLITICAL PARTY\"><img decoding=\"async\" src=\"images\/Adobe_PDF_file_icon_24x24.png\" alt=\"Adobe PDF file icon 24x24\" \/><span style=\"color: #ff0000;\">Download the procedure here<\/span><\/a><\/p>","protected":false},"excerpt":{"rendered":"<p>by Ngala JoshuaNairobi Kenya, Tuesday September 20, 2016 The Registrar of Political Parties has today issued a procedure for expelling members of political parties who violate the law.&nbsp; This guideline comes at a wake of complaints from the public requesting that some members of a political party be deemed to have resigned by their actions.
